Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TabBar website at tabbar.io (the "Site"). The TabBar for Word and TabBar for Excel applications (the "Apps") are licensed separately under our End-User License Agreement. Purchases are governed by Lemon Squeezy's terms, as described in section 5 below.
By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Who we are
The Site is operated by Yehuda Ben David, a sole proprietor registered in Israel (065954333). Our contact email is wordtab.support@bdtech.app / exceltab.support@bdtech.app.
2. Use of the Site
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the Site. In particular, you agree not to:
- Attempt to gain unauthorised access to the Site, its servers, or any related systems
- Probe, scan, or test the vulnerability of the Site without our prior written consent
- Use automated tools (bots, scrapers, crawlers) other than well-behaved search-engine indexers
- Upload or transmit viruses, malware, or other harmful code
- Use the Site to send unsolicited communications
3. Intellectual property
The Site, including its design, text, graphics, code, logos, and selection and arrangement of content, is owned by Yehuda Ben David or its licensors and is protected by copyright, trademark, and other laws. Nothing in these Terms grants you any right or licence to use any trademark or copyrighted material except as expressly permitted in writing.
You may view and use the Site for your personal, non-commercial information. Any other use requires our prior written consent.
4. Third-party links and services
The Site may contain links to third-party websites (such as Lemon Squeezy's checkout pages). We do not control those websites and are not responsible for their content, privacy practices, or terms of use. Your use of those websites is at your own risk and subject to their own terms.
5. Purchases and refunds
Licenses for the Apps are sold and fulfilled by Lemon Squeezy Inc., our authorised reseller and Merchant of Record. When you complete a purchase, you are entering into a transaction with Lemon Squeezy. Lemon Squeezy's Terms of Service and Refund Policy apply to your purchase, including any rights of withdrawal under EU consumer law.
For users in the European Union and the European Economic Area, the EU 14-day right of withdrawal applies to digital purchases, subject to the limitations set out in Lemon Squeezy's refund policy.
For users in Israel, the right of cancellation under the Consumer Protection Law, 5741-1981 applies as administered by Lemon Squeezy.

6. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Some jurisdictions do not allow the exclusion of certain warranties. To the extent we cannot lawfully disclaim a warranty, our liability is limited as set out in section 7.
7. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE.
Our total aggregate liability for any claims arising from your use of the Site will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) US$50.
Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud, gross negligence, death, or personal injury caused by negligence.
8. Indemnification
You agree to defend and indemnify Yehuda Ben David from any claim, demand, or expense (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Site.
9. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, if you violate these Terms or applicable law. You may stop using the Site at any time.
10. Changes to these Terms
We may revise these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be announced on the Site. Your continued use of the Site after a change constitutes acceptance of the revised Terms.
11. Governing law and disputes
These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. The competent courts of Tel Aviv-Yafo will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except that consumers in the European Union and other jurisdictions may have the right to bring proceedings in their place of residence under applicable mandatory law.
EU consumers may also use the European Commission's Online Dispute Resolution (ODR) platform.
12. Miscellaneous
These Terms, together with our Privacy Policy, EULA, and the Lemon Squeezy terms referenced in section 5, constitute the entire agreement between you and us regarding the Site. If any provision is held unenforceable, the remaining provisions will continue in full force. Our failure to enforce a right is not a waiver of that right. You may not assign these Terms; we may assign them in connection with a corporate restructuring or sale of assets.
